Acceptable Use Policy

This Acceptable Use Policy ("AUP") sets out the rules and guidelines for using MarketShot AI's AI-powered image generation Service. Our goal is to ensure the Service is used responsibly, safely, and in compliance with applicable laws.

MarketShot AI provides AI-powered product photo generation for ecommerce sellers. Our Service is designed to create marketplace-ready product images from source photos you provide. Key details about our AI technology:

• Primary AI provider: Photoroom — our image generation and editing is powered by Photoroom's API.
• White-background images use AI-powered background removal (segmentation) rather than generative recreation, preserving the original product pixels.
• Lifestyle scenes use AI background generation to place your product in different contexts.
• All generation requests are screened by our content moderation system before processing.
• AI-generated content may contain inaccuracies. Always review generated images before commercial use.

STRICTLY PROHIBITED: You may NOT use the Service to generate, create, or distribute any of the following content:

• Sexually explicit or pornographic content of any kind
• Nude or partially nude images, whether real or generated
• Content depicting sexual acts or sexually suggestive poses
• Content intended for sexual gratification or adult entertainment
• Deepfake pornography or non-consensual explicit imagery
• Content sexualizing minors in any form
• Bestiality or any illegal sexual content
• Content that violates obscenity laws in any jurisdiction

This prohibition applies to all forms of content generated through our platform, including but not limited to background scenes, product placements, and any modified images. Attempting to bypass our moderation filters to generate prohibited content is a serious violation and will result in immediate account termination.

In addition to the NSFW prohibitions above, you may NOT:

• Generate content that is illegal, harmful, threatening, abusive, harassing, or tortious
• Generate content that promotes violence, hate speech, discrimination, or harm to individuals or groups
• Generate content that infringes on the copyright, trademark, privacy, or other rights of any third party
• Generate content depicting real people without their consent, especially for misleading or harmful purposes
• Generate content involving minors in any inappropriate or exploitative context
• Use the Service to create counterfeit products, fake reviews, or deceptive advertising
• Use the Service to generate content that could be used for fraud, scams, or identity theft
• Use the Service to generate political campaign materials without proper disclosure
• Attempt to reverse engineer, decompile, or extract the underlying AI models
• Use automated systems to access or scrape the Service without authorization
• Interfere with or disrupt the Service, its servers, or its networks

We are committed to preventing the generation of prohibited content. Our content moderation approach includes:

• Automated screening of every generation prompt using Creem's Content Moderation API before credits are spent or an image provider is called
• Only prompts that receive an allow decision can proceed to generation; deny and flag decisions are blocked
• Generation is stopped if the moderation service is unavailable, times out, or returns an invalid response
• Reserved right to manually review content when flagged
• Account suspension or termination for repeated or severe violations
• Legal reporting of illegal content to appropriate authorities when required

Moderation is applied across all prompt-based generation endpoints on our platform. If your request is blocked by our moderation system, you will receive a notification explaining that the content violates our policies.

As a user of the Service, you are responsible for:

• Ensuring all content you upload and generate complies with this AUP and applicable laws
• Reviewing all generated images carefully before using them commercially or publicly
• Ensuring you have the right to use any source images you upload
• Verifying that generated product images accurately represent your actual products
• Complying with the terms of service and content policies of any marketplace where you use generated images
• Not attempting to bypass or evade our content moderation systems
• Reporting any harmful content you encounter on the Service to us

When using generated images for commercial purposes (e.g., ecommerce listings, marketing), you agree to:

• Accurately represent your products — generated images should not misrepresent product features, quality, or condition
• Comply with all applicable advertising laws and regulations
• Honor marketplace-specific content policies and image requirements
• Not use AI-generated images to create false or misleading product claims
• Retain original product photos for reference and quality verification

We may investigate suspected violations of this AUP. Consequences for violations may include:

• Warning and content removal for first-time or minor violations
• Temporary suspension of generation privileges
• Permanent account termination for severe or repeated violations
• Forfeiture of unused credits for accounts terminated due to policy violations
• Legal action if violations cause harm or violate applicable law
• Reporting to law enforcement for illegal content

We reserve the right to take any action we deem necessary to protect the safety and integrity of our platform and our users.
